The website http://www.europacorp.com (hereinafter referred to as the “Website”) is the property of EUROPACORP, a limited company (SA) with capital of €13,932,353.06, registered on the register of companies of Bobigny under reference number B 384824041, whose head office is located at La Cité du Cinéma, 20 rue Ampère, 93413 Saint Denis Cedex, France. Publication of the website is managed and operated by EuropaCorp.

The Webmaster of the website is Mrs Sarah Del Pino.

The contractor providing direct and permanent hosting of the website is LINK BY NET whose head office is located at 39, bd Anatole France, 93200 Saint-Denis, France. The contractor that created and developed the website is STARTR whose head office is located at 4-5 Bonhill St, London EC2A 4BX, England.

The users of the Website acknowledge that they have the skill and means required to access and use the Website. The users of the Website acknowledge that they have checked that the IT equipment used does not contain any viruses and is in perfect working order. The users also acknowledge that they have read this Legal Notice and undertake to comply with it.
The users acknowledge that they have been informed that the Website is accessible 24/7, except in the event of force majeure, IT difficulties, difficulties linked to the structure of the telecommunications networks or technical difficulties. EuropaCorp may interrupt use of the Website for maintenance purposes and will endeavour to notify users of this beforehand.


PERSONAL DATA


In accordance with the French Data Protection Act of 6 January 1978 as amended by the law of 6 August 2004, the automatic processing of personal data carried out via the Website has been declared to the French Data Protection Authority (CNIL).
Users are informed in particular that, in accordance with Article 27 of the French Data Protection Act of 6 January 1978 as amended by the law of 6 August 2004, the information provided by users via the forms on the Website is necessary to meets their request, and is intended for EuropaCorp which is responsible for processing it, for the purpose of administrative and commercial management.
Users are informed that when they visit the Website a cookie may be automatically sent to their browser. A cookie is a file that does not make it possible to identify the user, but is used to store information about the pages visited on the Website. Users can configure their browser to disable cookies. Users have the right to access, modify and delete the personal data provided by cookies under the conditions specified below.
The information concerning users is intended for EuropaCorp. In accordance with the French Data Protection Act of 6 January 1978 as amended by the law of 6 August 2004, users have the right to access, modify, amend and delete their personal data (Art. 34 of the French Data Protection Act). Users can exercise their right by sending a request to the Webmaster of EuropaCorp at La Cité du Cinéma, 20 rue Ampère, 93413 Saint Denis, France.

Users of the Website are required to comply with the requirements of the French Data Protection Act of 6 January 1978 as modified by the law of 6 August 2004, breach of which is punishable by criminal penalties. In particular they must refrain from collecting or misusing in any way the personal data they access, and in general from any actions likely to infringe people’s privacy or reputation.


COPYRIGHT/TRADEMARK LAW/DATABASES/HYPERTEXT LINKS


- Intellectual property:

Unless otherwise stated, the general structure and the software packages, texts, animated and non-animated images, sounds, know-how, graphics and all other elements comprising the Website are the sole property of EuropaCorp and its intellectual property rights are reserved for the whole world by its holders. Furthermore, unless otherwise stated the intellectual property rights relating to the Films and their components, photographs and worlds are the sole property of EuropaCorp and its rightful owners. Therefore, pursuant to the French Intellectual Property Code (CPI), they are solely for private use, unless other or more restrictive provisions are stipulated by the CPI. Except for their private use, users are forbidden from copying, reproducing, distribution, selling, publishing, using in any other way or distributing in an electronic or other format the information included on the Website or the websites connected to it via hypertext links. Consequently, any total or partial reproduction or representation of this Website, of the websites connected to it via hypertext links and/or of their elements, in any way whatsoever, without the express written authorisation of EuropaCorp, is strictly forbidden and constitutes an infringement of copyright punishable under Articles L335-2 et seq. of the CPI.

- Industrial property:

The trademarks of EuropaCorp or its partners included on the Website, the titles of the Films and the logos included on the Website (whether semi-figurative or not) are registered trademarks protected under Articles L711-1 et seq. of the CPI.
Any total or partial reproduction of these trademarks or logos carried out using elements of the Website without the express authorisation of EuropaCorp is therefore prohibited, as specified in Article L 713-2 of the CPI.

- Databases:

The same applies to the databases included on the Website which are protected by the law of 11 July 1998 transposing into the French Intellectual Property Code (CPI) the EC directive of 11 March 1996 on the legal protection of databases.

- Hypertext links:

The hypertext links on the Website to other resources present on the internet, and in particular to EuropaCorp’s partners were expressly authorised beforehand in writing, but EuropaCorp cannot be held liable for them. EuropaCorp does not have the means to check these websites and their sources, and is not responsible for and does not guarantee the availability of these sites or external sources.
EuropaCorp does not appropriate the content to which these websites or sources give access, and disclaims all liability and warranties for this content.
The users and visitors to the Website cannot create a hyperlink to this Website without the express prior authorisation of EuropaCorp. Users who wish to create a hyperlink to the Website must send an email to the Webmaster of the Site to request authorisation to create a hyperlink. Silence on the part of EuropaCorp cannot on any account amount to tacit acceptance of the user’s request.


WARRANTIES - LIMITED LIABILITY


Users use the Website services at their own risk. EuropaCorp cannot on any account guarantee that the services proposed will never be interrupted. EuropaCorp’s obligation to supply information content is limited to an obligation of best efforts.

The items proposed comply with current French legislation. EuropaCorp alone is responsible for the information and services supplied. However, EuropaCorp does its best to ensure that the information published on the Website is accurate and up-to-date, and reserves the right to correct its content at any time, without notice. The publication of the Website may therefore include technical errors, misprints or other errors. EuropaCorp does not guarantee that the functions included in these documents will be provided without interruption and without mistakes, or that the website or server that makes them available will be free from viruses or other hazardous components. EuropaCorp takes every precaution to ensure that the content of the Website is not contrary to public order or morality. However, EuropaCorp cannot be held liable if ideas or images offend certain particularly sensitive people.

Consequently, EuropaCorp accept no liability for: any lack of precision, inaccuracy or omission in the information available on the Website; any damage resulting from a fraudulent intrusion by a third party resulting in the modification of the information made available on the Website; and more generally, for any direct or indirect damage, whatever its cause, origin, nature or consequences, due to access by any person to the Website, or the impossibility of accessing it, or to use of the Website and/or the credibility given to any information provided directly or indirectly by the Website.
